Those are the same symptoms of the vacuum line not being hooked up. I would suspect a bad vacuum modulator, or it is severely out of adjustment....
Sellers e-jipped....lol J/K. hopefully he will make good on your order. From what I have seen, he's one of the best fabricators there is.
To the best of my knowledge, the car is smog exempt and they shouldn't even ask about any changes.
