Yes,it sucks....................You can sue the guy for the damages to the car.Civil court isn't like winning the lottery.You'll get an award for putting the car back to the way it was before the wreck or money for a replacement if the car is wrecked beyond repair.You can't just sue the guy for a million bucks,doesn't work that way for property damage. WOW, that does really suck. Sorry to hear the news. As you stated you really need an agreed value policy. Both Grundy and Hagerty will pay the owner of the car to fix the damage if they are capable and their premiums are really, really inexpensive, seriously. Yes you can, it's called agreed value. The insured puts the value on his own car, including labor, to make sure he gets full replacement value. I guess you missed the part about him not having collision coverage

if he uses the "uninsured motorist" on his insurance the insurance will go after the guy to reclaim their money for sure.
