Ok so sat i was taking a drive down rout 66 with my wife my son and my 3 month old .I happen to go down a street that was having a check point i tryed to turn around but was stopped buy a cop who informed me to stay inline. I dont have any thing wrong with my license or anything just did not want to deal with the hassle of going through the line because they always seem to find something but its always a fix a tiket just a wast of time.So i go through and the cop tells me hey why is there steam coming from your motor i say it the original motor sometimes it runs hot and steams hey says its a smog problem and to pull over .So i do and as he says and my wife looks at me and smiles she has been around classics all her life because her dad restores and says do you think he knows what year this is.I wait for some time then a younger cop comes up and tells me whats wrong with my car i say nothing its a old car.He says he is sorry but he has to give me a tiket for exhaust products i say im smog exempt he says dont worry im going to write it as a fix a tiket i say how the hell am i going to fix it i will never pass smog smog back in the day is nothing compaired to today hey says sorry but my boss just said to write you up for it .I know my car smokes but not enough to be a problem it not even smoking out the exhaust it smokes some times after running it for a long time out the breather.Oh and then he says i really like your car though wtf. The whole time my wife is pissed off because right next to use is a guy that is just not going to pass the drinking test and she is telling the cop that he should be pulling people over that are drinking and doing drugs not us for just cruising .I dint even know what to say he just did not want to hear me out to make a long story short now i have a day in court.

the violation #27153 no motor vehical shall be operated in a manner resulting in the escape of excessive smoke,flame,gas,oil,or fuel residue

what should i do

 

take it in when the motor is cold and not smoking there problem is fixed.

You have failed to tell us where this happened, or what kind of car you were driving.

However, I would get a copy of the "law" that shows your vehicle is exempt, and take it to the court house. You should not have to go to court, a clerk should be able to clear everything up if your in the right.

Otherwise, just let it go... It's a sad fact, but the police ~can be~ as bad as the mafia sometimes. If you go out of your way to make waves, they could make your life very miserable.

I'm a cop and thats bull shit....checkpoints arnt for hassling folks...they are finding drunks and drugs and showing a pressence.

That said...your screwed....I can see the loophole they used...see they didnt write you for smog...cause your exempt....you can get a copy and take it with ya to court....but it likly wont help.

Just because your smog exempt doesn't mean you dont have to comply with the law as far as visual emissions...thats where they got ya...

The cop was just doing his job. He has no option to "interpret", that's the judges job. It's your legislature that wrote the law. "Visable smoke", is their shitty way of including everybody else in the "smog equipment expempt" clauses, just because they are not interested at all in individual rights. It's in their thumb-sucking genes. It's their agenda to have us all sitting our green yards, with clean air, with our immobilized 4-wheel lawn ornaments, basking in our memories of the good old days. There's no hope for improvement there. You're screwed.

I live in a part of the state of Colorado where there are no emissions tests required, BY CHOICE, and if that changes, I will move.

I'm sure trying to make a U-turn and get out of going through the check point didn't set the best tone either. The Police like to be in control, and trying to get out of their little check point is going to make them angry.

The cops around here are cocky SOB's that are 10 feet tall and carry Howitzers, and every week there is usually one or two of them that are being busted for selling drugs or stealing from the property room or the best one this year was running an escort service while on duty from his squad car.

I know its everywhere but what the hell happened to the morals around this country....

Exactly what I was thinking. There was a reason you didn't want to go thru the check, whatever it was, it gave the officers cause to pay attention.

I love driving my car and just recently i have started to drive the car longer distances and put more faith in it .So i just started to get the feeling of what its like to drive something that i have made around and enjoy it to its fullest.So if i have to end up paying a fine i guess ill do it because I enjoy driving my car .

good luck man. i have them problems with the checkpoints up here. never got through one without a lame excuse for a ticket. never got out of one either.

It's not a smog ticket. Excessive exhaust smoke can be written to any car. If the officer checked the "no" box next to the violation, it's a fix-it cite. If the "yes" box is checked, it's a fine. Regardless, each violation doubles the fine if you get cited in the same car.

Take the cite to your local PD and they can sign it off but there's an inspection fee. The CHP signs off for free if there is one close. Once you get the cite signed off, they should give you a receipt and/or a letter of compliance. Take the cite and letter to the court and the case is closed.

I don't live in (insert any other state),but I have been to a few other states in my lifetime.All have their good and bad points.
Some get a lot of snow,rain,heat and "crazy people".
We just happen to have way more than others.

1.When you come up to a checkpoint and you try to avoid it by turning around,what do you think is going to happen?
2.FIX the problem that causes your car to overheat.

I would tell them your car was starting to overheat cuz you were waiting in line, that's the reason you turned around to try to get some airflow. He saw "steam" coming from the engine cuz it was hot.
