In 2007 I designed a chassis for a slightly OT car I built. I made CAD plans and copyrighted them. I sell a good number of them on the auction site.

So today, I ran accross this guy's website selling MY plans, using MY exact photos to peddle them! They are not close to mine, They are exactly the same.

He also has pics of this car but no contact info. I'd like to talk with him. Any info appreciated, Here's the car:

The car is on youtube but I am betting that is not really his car as that car is all over the net, probably took the picture from somewhere as well.

Did you have a lawyer do the copyright work. Have him send a cease and desist (? Sp) letter. It is my understanding it is your responsibility to police and enforce the copyright. Should be easy to stop him although it will cost you some money.

I'd be having a lawyer track him down.

I submitted the copyright myself. I have the certificate to back it. The only problem is, there is no contact info on his website. Just a paypal link to buy and download. The page was put up last month.

I'll find him. One way or another...

I posted a comment on his website just to let him know I know. All of the sudden he is "down for maintenance".

OK I am not a copyright lawyer but this is my understanding of the current law...

If you did not file for copyright, you still have it -- under the Berne convention which the USA is part of.... so you can get a cease and desist... and damages if you can prove any.

However if you did file (which it appears you did), you are in addition entitled to "statutory damages" for copyright violation, which means you do not have to prove any actual damages to collect a significant amount.....

    Bottom line -- consult a patent/copyright attorney.

I agree with Miller, contact E-Bay they don't want any nonsense on their site and they will take care of it!

Hope you can make him stop. Getting damages etc will most likely involve more money than you will recuperate. Only lawyers win in cases like this.
