Northern Nevada HAMBers who are cops

My Dad spent his whole career in the U.S. Customs, it always amazed me when i was a kid that when we crossed the border he simply flipped his wallet open to show his badge at the Canadian Customs and the officer just said something like "Have a nice day".

In my area I'm around a lot of badges, Town, City, County Sheriff, Corrections Officers, etc. There's one NYS Trooper in this area that don't take no crap, he treats everyone equal. Well keeping your badge next to your license is common practice.

Everytime he nails one of these guys that pulls the old "badge & license" trick this Trooper tells them that the only badge he recognizes is his own.

Spooner has been a speed trap for over 50 years! No surprise you got a ticket.

 

Had alot of tickets, well a whole lot of 22350's and 22349's enough that I remember that, I was always respectfull usually a wise ass but never disrespectfull, only twice that I remember did I get a ticket I felt I didnt deserve and once that I was cuffed and roughed up in a case of mistaken idententy, but with all the old school cops I knew and the police chiefs daughter I was friends with, I never asked for anything other than advice on how to deal with a paticilar individual and situation, I did borrow a code book for research on a ticket I fought. The one time with the bad cop crap I went through I was asked to leave it alone since they wanted to deal with him inhouse rather than it all be made public so I did!

Anyway besides my add rant my question to 1959apache is are you asking for a favor of some kind from a cop because he's a fellow hamb member or just asking for advice on how to deal with the speed trap you got caught in?

 

The HAMB is great, but this thread has nothing remotely close to being "HAMB friendly"....

So, did you pass on a solid line, or double yellow line? Did you pass in a marked "No Passing" area ? Were you over the posted speed limit at the time of the infraction?
Do you know that you have to sign a ticket, which is only an acknowledgement that you will appear in court at the designated time/date?
You do know that a police officer is not a Judge?...Don't argue with them!
Back to my original question,
What kind of help do you need?

on a side note if the whole things you just cant afford to pay the fine, try for community service my mother in law does it at her church every time she gets a ticket..

 

I noticed my mistake while in the airport that it is Northern Nevada. (it doesn't help not getting much sleep) I have been stranded at the Vegas Airport for 3 days trying to fly standby because another airline delayed the plane for 2 hours and caused me to miss a connecting flight. I just got home 3 hours ago.

Firstly, my marriage and honeymoon were paid for (all-inclusive) by either wedding gifts or family, knowing full well I cannot afford to do this stuff on my own. What this has to do with anything is beyond me....

For everyone else who is making a lot of assumptions I am not asking someone to do something illegal, which would be pretty stupid to do on a public board, especially with a title such as the one that is on here.

The section of Spooner I am referring to is a 4 lane highway, separated by a cement barricade, two lanes up and down. The lines are dotted (for passing) and the area was the straight stretch that goes to the light at the bottom or the start of the way to go to Spooner (where passing is legal). What I did was justified and I was going 10 over to pass the oriental tourist driver that couldn't keep his compact in one lane even on the straight stretch. The Sheriff was hiding in the usual spot at the lot at the bottom where all of the shuttle buses for the casinos pick up the employees. In they eyes of the law I was speeding by 10, but it was to prevent an accident. The lady Sheriff that pulled me over was there to make sure I knew that she was the queen of the road when she got out of the car and wouldn't let me get a word in.

I am wondering if Sheriffs in Nevada are required to have their parking lights on or anything like that like that did a while ago in California. OR if there is any local law or anything I can get the Sheriff on for hiding in that area or in a speed trap in general or parking in the casino's lot (if that is their property)? I know this has been a speed trap many times and also if I can reference another HAMBers case that was able to get out of it then that would only benefit me.

Lastly, I am back in Indiana and won't be able to make it back to Nevada for any kind of trial date, so I am also wondering if writing a letter to the judge is even going to be worth it. There is more to reply to but I am tired of typing. Thanks for the help to everyone who has helped or actually has something that can benefit this situation

If you lived here for 16 years, you should know of our "Cowboy Cops".
Lastly, write that letter. Even if it does'nt do any good, at least you will know that you tried to explain your case/side of the story.

 

When I'm driving behind someone that is driving stupid (impared or just a bobo) I stay behind them at a safe distance, never pull up next to them for ANY reason. If they are really bad (drunk/stoned) I also call DPS and they take them off the road.

Ticket is yours, own up to it.

 

I crossed a double yellow line to avoid a school bus (full of kids) that was going to hit me because the driver couldn't pull out into a 4 lane road without making a wide right (while I was along side of it).

A cop was right there and saw the whole thing.

GUESS WHAT???

You guessed it! I got a ticket for crossing the double yellow.

Went to court, told the judge this whole story, the cop backed up my story.

The judge looked at me and said "you crossed a double yellow"!

GUILTY!

Do you see some similarity here?

I got cited for the same thing years ago and tried to fight it in court. The bottom line is that when passing another vehicle you cannot go above the posted limit, You will be speeding at that point and breaking the law. Also the "basic speed law" does not apply because you were passing another motorist and by going faster than the limit posted you are the one creating the unsafe situation. Now ask me if I agree with these And I say no, But you gotta admit there is some merit as to why this is law.

I had a long day at work and busy doing family stuff (Note: I was employed when I got married...don't think my wife would have married me otherwise), and just got a chance to sit down and check out the the HAMB. Lots of Laugh Out Loud comments here!

Sorry apache dude...you can hate me, but I don't think you get what life is all about.... Pay the ticket and forget about it. ...get a job, be good to your wife and get on with your life..

You can bring up parking lights, his parking spot, color of his car, and the fact Sheriff was a bitch and did not congratulate you on the wedding.....

The judge will not give a shit.

Bottom line, you violated the law, and when she says you were driving a fully loaded 12 passenger van, speeding and passing, THEN you are refusing to sign the ticket.....good luck. Best bet is to pay it and ask for a reduction.

Ok...Done is done.

For 59Apache, you got a speeding ticket because you thought the guy in front was going too slow, and it was unsafe to be going that slow.

Consider..... going 60 miles an hour, it will take you one hour to get where you want to go.
Going 50 miles an hour, behind the slow poke, it will take you 12 minutes longer.

Going only 10 miles, the slower car in front is only going to be a minute and 20 seconds longer time for you.

Is 12 minutes worth a $150 ticket, on a 60 mile trip, or a minute and 20 seconds for 10 miles?

Come to this part of the country, at this time of the year, and get behind a combine going down the road at 25 miles per hour!!!!! Enjoy the scenery.


Remember the old story about the young bull and the old bull, and being in a hurry? Same thing applies when it comes to speeding in a vehicle.

Going fast is for the race track and Bonneville......



Is this thread H.A.M.B related? Sure it is...think of all the hot rod parts you could buy, if you don't have to spend the money on speeding tickets.

Write your letter to the judge and ask for no points. Have someone read YOU your letter before you send it. Everything you said sounds absolutely right...TO YOU. Nobody here is buying it because you knew it was a speed trap, you admit to going 10 over, YOU think it was safe, but blind justice says YOU are not allowed to pass judgement on other drivers that are within the limit. And you forgot the biggest speed trap rule. "9 you're fine, 10 you're mine". Anything below 10 over seems to get a pass all over this country. I don't slow down to 65 in a 70 because a cop is there, I don't drop to 70 if I'm going 74-5 either. You fucked up and gave Mrs Badass a reason to generate income for the county. Give em their money and remember the details.


BTW, congrats on getting married. That is, if there was no shotgun involved

 

Hmmm. In your letter to the judge, I think you might have a bit of justifying to explain what accident you were preventing, by following someone else.......then speeding up to get ahead.

Always remember...There's a time to listen, and a time to talk.....Some days it just pays to listen..(Now that you're married, you'll know what I mean) It will also apply in situations like you just experienced.

Years ago I got a ticket for 75 in a 65. Tried talking my way out of it, no dice. The cop said something I remember well.

"Do you know what the word 'limit' means son? The speed LIMIT is 65. That doesn't mean 66, 67, or 75. You exceed the limit you can expect a ticket."

You were speeding and you admit it. Doesn't matter if you were late for a flight or passing a dangerous bus full of nuns, you were in the wrong. Wanna piss off the judge? Try to rationalize it. Nothing wrong with asking for a reduced fine or no points, but don't try to tell him why it was okay for you to break the law, thats just stupid.

 

Way too much here to quote so let me ad this, years ago it was pointed out to me that avoiding an accident is not an excuse for speeding. That would have been in the 70s and it was pointed out to me by the circuit judge to the tune of 90 days and 250 dollars. He was kind enough to suspend the 90 days, he said that I would probably eat more than the 250 in my time of incarceration.

If one is following someone who is weaving all over the road it is not a good argument to say that you are passing them to avoid an accident. Just think about it for a minute.

Lastly it was explained to me that speeding tickets are revenue. This was explained to me by a Kansas Officer while he was busy writing me a ticket for 3 miles over the speed limit. I didn't really mind paying the ticket, I was running at least 15 miles above the speed limit just before I topped the hill. You know where this is going right? We all break traffic laws pretty much on a daily basis, some of our infractions are minor and others are not, but we don't get caught on a daily basis. When you get caught it is time to pay your dues. It is revenue pure and simple, the cost of using a highway.

I like the story about the reason a person said to the cop...

"The reason I was speeding, was I thought you were the cop my wife ran off with, and you were trying to catch me, to giver her back"!!!!!!
