History City says GET RID OF THE CARS! FINES! What?

    Land of the free and home of the brave.... Wait... Free? What happened to owning a piece of property and being able to do whatever the H*#^ you wanted to with it. Now we have restrictive covenants, home owners associations, and ENFORCEMENT OFFICERS? Please. I hate being told what to do with what I own.

    AS a retired Fire Official part of my job was code enforcement. I would write down every time you talk to him. Make sure you add the date and times and every word he said. By him keep changing what he said, sound to me that there may not be a code or he does not know his job. If he is saying that he is going to cite you and you ask for the code he has to either give you a copy of it or atleast give the the code number and what code it is. Local county or state. If you go to the city/borough hall and ask for a copy of the code they have to give it to you. You may have to pay for it.

    If he would let one person to cover, fence in or any other salution to keep the car. Then he has to allow everyone else to do the same thing.

    If he site you the code number and time allowed to fix the violation has to be on the citation. Also on the citation there has to be a section for appealing it and how many days you have to appeal it. Also either what action or a number to contact the city so you can apply for the appeal.

    I would also check the city code on Right of entry. Some areas he can only come on your property with you permission or there is unsafe, dangerous or hazard to human life. Other then that he need to do every thing from the street or get a warrant to enter your property. Also if he said someone file a complaint he has to show it to you if you ask to see it. Also he needs his Id and has to show it to you. And not just flash it. If he is found to be in violation of this, then every thing he did to this point could be thrown out in court.

    I seen a lot of code official loss there certs. for not knowing there job. The city is responsible for every thing he said and does. And if Tenn. is like most states he should have International Code Council Certs.

    Oh believe me the Code official were I live tried his act on me until he found out I also had International Code Council Certs. He still has his job Only because I dropped the complaint against him. I also teach the code classes at the local college.

    On the bright side, at least it's not your neighbors pissing down your leg.

    When I lived in South Florida one neighbor complained on the other and the code enforcement officer went to the house that got complained on, then wrote a citation for every violation he could see from that driveway, figuring he'd get the tattle tale in the process. The crap stopped real quick, thankfully I didn't get hit with anything.

    That stuff goes on everywhere to some degree. Different areas just have higher or lower degrees of it.

    I've found out though the years that if people start getting harassed by the city or county for cars or other stuff in their yards it is usually due to some busy body complaining or making it their business to bring it to the city manager's or code enforcement officers attention. In McGregor, Tx it was three or four old biddies who rode around town in one of them's new white Cadillac in the early evenings making notes of things that they didn't like. At that time if you had current and valid tags on the car sitting in your yard that was all you needed to get by. My 34 Olds didn't have glass, engine or interior but it had brand new shiny license plates prominently displayed. One of my buddys had probably 30 cars and trucks in his yard (2 acres) for several years and got along fine until he got a building permit for his house. Now I think he is down to a half dozen and may still have to get rid of a couple more or build a building to keep them in.

    Sometimes we are our own worst enemies on this. We don't move cars around in the yard often enough to make things look different and we may not mow or pull or kill the weeds around them as well as we could. Sometimes all you have to do to keep out of hassles is to keep the car somewhat clean and move it to a different spot when you mow the yard so it doesn't get a fringe of grass around it.

    Just about every city in america has a deralict law reguarding housing/ property most say that any vehicle on the property needs to be running, licensed and insured other wise they get towed away, even if they are out of site in the back yard.

    A junk car or truck seems to be a town requirement where I live. Parked in plain site sinking into the earth.I don't know if there's any codes about it but I have enough property so nothing can seen from the road,not even my house.
    Yeah,it's my property, I can do what I want.Yes you can until your shit spills over on the neighbors property,be it noise ,smell or visual.
    One guy moved out into the country so he could do what he wanted.His neigbor thought the same and had a private Moto Cross track that roared all weekend into the night.You couldn't even carry on a conversation in his house.
    Be careful what you wish for.

    i fought this fight 15 years ago. 3 years in and out of court even had proof the code officer was laying. they even said i had to junk my running tagged 66 corvette. what got them off my back was the news paper. they did not want to deal the news being out.

    some one said get a lawyer and got to court. they are right if the lawyer says to just go the fine is less then my fee. get another lawyer. because you go you pay the fine. then they have you in the system. and then they will play hell with you.

    we bought a place out in the middle of nowhere now the way it sets they can not see anything from the road.

    also if the cars are tagged and insured they don't have to run. that is what the state of pa. said when all the little towns were comming down on eveybody.

    Friend of mine in western oklahoma is having the same problem. He has ha the cars around his house for years without any probems until now. The real screwed up part is that he has been putting on a car show there for years that draws all kinds of people to the town let alone some dollars. No complaints from the city fathers on anything to do with the show.

    Oh yea. I do not know how many times someone tried to get me in the middle of a neighbor fight. Basically did the same thing. And the best part the complainant gave me permission to be on his property.

    BOB308 You are right about Pa. I have seen a lot of code official get there head handed to them on that on. This one code were Pa. said on one in the Commonwealth of Pa. can override it. The Christmas tree code is another one.

    I rent a warehouse for my toys and a few sit outside in a industrial area,for the past ten years the city did not care,last year i was told i will need to buy a permit,one for each car to have them outside?,under a cover?,,yet across the train tracks in a housing comunity i can see a redneck tearing apart a 4 wheel drive on his front lawn??,,the code cop had nothing to say,,had to pay for the permits,,,i guess the fact he was wearing a camo hat did not help,,,rednecks,,,,,
     
  12. They tried to get one of mine with a 10 day notice in a registered letter.
    Said it was a public nuisance (an obnoxious or annoying thing)
    It's inside now.
    Probably not your neighbors. More like building inspectors trying to hold on to their job.

    Your point being on the politics i guess is that its Ryans board and he dont like politics, he might close the thread, lock it, ban somebody etc.... I respect that, its HIS board.

    BUT.....If your point is politics and Hot Rods dont mix ..... well that may have been correct at one time, I think something Rob Fortier said in the recent issue of Rod & Custom speaks to the issue.

    Not busting ya balls HEMI32 (and I hope u werent mine!) but what I'm saying is I think its too late here where I live..... were screwed and didnt even get a kiss.

    I went to 4 guys and offered to put their cars in my shop till they can find another place.
    I feel bad for these guys, I helped each one find a car, haul the cars, work on the cars....... I think its the least damn thing I can do till we try to get things sorted around here.

    This happened to my dad with his Mustang. It was in the drive way and someone called the city on him. The guy came and said he had 30 days to get it running (impossible at the time) so we built an enclosure under the deck and stored it there. The guy came back and dad told him we got rid of it, and since he had no right to search the property, he said ok and left. People are asses and dont care about old cars.
     
  19. You just have to know the law and outsmart the codes guy, if need be go to court. Been through this a few times and have always beat them by just putting a set of plates on the car. My buddy threatened to run for town judge when they went at him and he knows like everyone in town, family has lived there for 4 or 5 generations, so they backed down.

    This is one of the reasons I live way out in "farmland". The farmers have way more stuff than I ever will, and make more noise too. Plus, I don't have to listen to my neighbors arguing, etc. My nearest neighbor is over 100 yards from me.

    Still gonna sign up with the Sema Action Network though. Good luck, HellBilly...and anyone else who has this problem.

    That is a view of my driveway. Never get hassled by anyone, I don't know how anyone could stand living in the city. But I guess it is better that busy-bodies stay in the city and not out in the middle of no where :)

    as soon as a house three spots down was up for sale i noticed the real estate guy would drive slowly pass my house
    within a week i had some smuck come up to me and asked me what i was doing with this car in my driveway and that he was from the town
    i told him it was none of his buisness and to get off my property and if he had a problem call the cops and tell them to run my tags i have on it
    classic insurance is too cheap not to have it even on a project
    i have american collectors who's a vendor on the h.a.m.b
    i pay 127 for two cars a year the next day i parked it at the curb for a month and gave the real estate guy the finger everytime he drove by
    im nice till somenone messes with me then its game on
    i hope you guys find an easy solution

    Ummm ... No! ... I was simply providing you links to some other threads on the subject ... threads where folks made some pretty good (& pretty stupid) suggestions on how to handle the situation you find yourself in.

    As for me being a "politics & hot rods don't mix guy" ... you haven't a clue about me or my background (or my father's history with NSRA, Goodguys, misc. Rodding publications ... and SEMA).

    My statement about keeping "the politics out of this thread" was actually a plea to keep this thread alive! ... I know from past experience with these types of threads that some HAMBers feel the need to resort to making the discussion about Democrats & Republicans; Conservatives, Liberals, Socialists, & Marxists; FOX News vs. MSNBC; etc., etc. ... and then the Moderators put an end to the thread.

    Glad I live in Berkeley, CA. They don't seem to have much problem with old cars here and in fact seem to like them. Now, we have a lot of other problems, but old cars and people who like them seem just fine. I am sure there must be similar laws of some sort on the books here. But, the fact is, most people try to get along reasonably well for the most part and accept that not everyone needs to be just like them or perfect. Works well for a lot of things, but notably for people who like old cars.

    What you want is a copy of city ordinance 2092 (zoning). It is not on the web site but the web site does mention it and says it's available in the city recorder's office.

    "Ordinance No. 2092, dated July 19, 1977, and any amendments thereto, are published as separate documents and are of record in the office of the city recorder."

    Once you have that you'll be able to tell what the requirements are and what you're going to have to do to comply with it.
