Default Ripped off

I paid this guy for white walls and to bag my car, he told me he was going to get the parts. Three weeks went by no work was done on my car, no parts and he wouldn't answer my calls. I was finally able to get my car that was left on a dirt road with my keys thrown on the floor board, THANKS! I got my ride but how can I get my money back? I'm sure i could try the court system but this guy is hard to find. Any suggestions?

He no longer has a shop, he closed it down in Murrieta moved to OC then that shop was closed. From what I am finding out I'm not the only one he ripped off.

Sue him in small claims. To serve him, just have a buddy he's never met answer one of his ads like they're going to buy whatever he has up for sale, and hand him the papers. If he doesn't show, you get a judgement against him. Probably only worth the paper it's written on but it will follow him around for a long time.

I know a guy that has been screwing people over on thier cars for several years. good gig if you can get it and have no morals, since it is civil and not criminal and the cops could give a shit.

get sued, go to court, get a judgement against you and don't pay, then screw the next guy.

IIRC (and IANAL) but a small claims judgement holds when he sells his property. So, if he owns a home, and you know it's up for sale, just attach to the sale.

Small claims cases can cost about $100 to file, as I understand; usually, they're filed in the county where you were ripped off; and I BELIEVE you need the person's real name, and some information about them--place of business, residence address, their car make, model and license number.

And even if you win in court, which sounds likely, all that means is you are legally within your rights to demand that money. That doesn't mean this jackass has to pay you, though--and he very likely won't.

Still could be a satisfying endeavor, though--especially if, after you win a judgement against him, you were to send a copy of the entire case to, say, the Riverside Press-Enterprise or the OC Weekly or the Orange County Register.

I guess i am old school. To me the amount you paid him is not important. You did it in good faith and expected to get what you paid for.

I know of this happening to some one very close to me. He didn't recover his money. However for another 500.00--750.00 and the right people-------- Its my understanding that the ripper now walks with a limp
and dosen't have good use of his left hand. Needless to say he is now in a diff. line of work, when he can get it.

I got stiffed back in the 90's, guy was supposed to paint a car for me, friend of a friend, I fronted a bunch of money. He stripped it down, and then stopped working on it. Little did I know that his wife kicked him out for cheating on her, and he let his business go to sh%%. I sold the car at a loss covered in surface rust. The guy had to move out of state because other folks with less restraint than me started to do things to his daily driver and shop.

I have been having the same problem with another guy. I have been told get a note written up called a promisary note. This not will have the amopunt he owes you and if he doesn't pay it up you will collect a different way. Then do like said above have a buddy get in touch with him and end up serving him with the paper. After however much time you gave him if he does not pay up. You can go to his house or shop and load up anything you want to take home with you and you can get a police escort to o with you and they make sure he lets you. I know that there is probably a little more to the process but that much is what I have been told about my similar situation and I am working on doing it myself.

Another piece of advice is don't go find hima nd whoop his ass. I did that the first time I found my guy I stomped his ass and took the money that was in his wallet. it was only 17 bucks out of the 2300 he owes me. Then he went to the police telling them I mugged him. However while I had him on the ground I did make him write me out a contract saying he would pay me and when and what for, signed and dated by him. haha

Dirty Steve was a member of the Knight Owls not sure what happened with that car club. He is now a member of the GONNERS SO CENTRAL. I wonder if they really want their reputation tarnished by Steve's unethical practices. I hope the rest off this car club does not stand up for a guy who rips people off.

Yeah I have been ripped off before. Took a boat motor to a guy to have rebuilt. The motor was locked up but I took him the complete motor with a nice carb, new intake manifold and nice valve covers needless to say the guy kept blowing me off. Never saw the parts again. I learned a hard lesson and come to find out someone was so pissed off at him they vandalized 6 of his customers cars, his shop and his personal cars. FIled a claim against the BBB and tried to take him to court. Never got a dime out of it.

I had a similar situration with a custom shop in Tulsa. The guy does crap work, but all the young dweebs didn't care, they just wanted their ricers slammed. I saw a truck he'd done and asked him to do mine the same way. He kept stalling and stalling, finally said it was done. It was total crap, didin't have half the things we agreed on done, and he had it about a year! Right after that I saw a news show about the guy and his poor business practices. Know what happened? His business increased about 200%!!! Unfortunately; it does appear that there's no such thing as bad press...

Hung out with him at a few spots, he had a shop in Murrieta and OC,but of course I didn't get the real story as to why the shops were closed. Of course I heard from him on the regular till I gave him my money. He's smooth in his art of stealing. Even saw him at VIVA and got a bad vibe from him.

Small claims for sure. Verbal agreements are enforcable. I'd suggest an hour in the public library and get the #s of the laws and ordinances he's broken to go with the breach of contract. The threat of legal fines will make yours look cheap. Push it. Don't just roll over on the gig. Get a list of others as well. Nail this prick by the balls!


On the condition of course that your side of the storie's true. Remember there's 3 sides to every case like this. Yours, theirs, and the truth. Stick with the 3rd one and good luck.

You are correct highlander. I do have a list of others this has happened to. I was patiently waiting for him to do the right thing gave him 2 wks to cough up my money. He hasn't so now I want to get the word out so this does not happen to anyone else.

Pretty common in socal, I've had it happen to me a few times over the years (really gotta watch out for those fab guys..they tend to be flakes.). It's one of those deals where you really gotta do your homework up front. When I went to build my up my drag car the first time I wanted a chromemoly cage so wanted it professionally tig'd took it to what appeared to be a reputable shop, gave the guy a deposit, he gave me a recite then jerked me around for months (I would go there a couple time a week to hound ...always the same story "tomorrow tomorrow" ) Eventually he left the car outside were it was stripped, it took me months of fighting with him to get him to finish up and repay me for what was stolen, and over that time I met so many people with similar stories (Note to all stay away from Rj Simrock (he switched over to imports, but still pokes his head around domestics & nhra). I've known some guys that have done the same to others, a lot of great mechanics make really shitty businessmen.

Either way wish you luck.. If your looking for a good shop in SD, talk to Abe @ San Diego Rod and Customs. They are good guys and get things done when they say they will.

Truth be told, you're damn lucky to have your car back . . . it could easily have disappeared along with Steve.

Like most lessons in life - they come hard. I would never leave my car with anybody other than a known shop, that I had inspected, that I knew had insurance (or that I knew my car was insured to be at), etc..

One look at most shops and it is easy to see why certain ones are busy, why they charge what they do, etc.. When you see a real clean shop, clean operation, nice cars, nice clientele - it is all because somebody does quality work and knows how to run a good business.

It isn't rocket science to find good suppliers and shops . . . just takes a little bit of time, some paper work and some clear expectations to get it right ( at least most of the time!).

sounds like a freind of mine, who has a 67 camaro(I know)anyway took it in to "a guy he knows" 4 years later he gets his car back,(i think). i was at the parts store with him a while back, and a guy was tellin my freind that his bro had just got his trans am back after 2 years for a stinkin' paint job! anyway at least you were able to get your car back.

Sorry about your bad experience. My experience in the early 90's with outside support in getting a roof fill redone on my 32 was interesting. Very talented guy (also named Steve) working in a small shop in Corona. Calls me one day after he has had my car a couple of months to say he sold his business and was going to work for a Gold Chainer who opened a place in Temecula and did I want him to finish or not. Well the car had a big hole in the roof and he already had the new fill panel so not much choice. I said OK as long as our deal stayed the same. Got a call from the Gold Chainer a few days later with new hourly rate, (he said Steve told him that's what the deal was), and an estimate of $40K to make it a real show car. I told him I only wanted the original contracted work completed and at the same rate. Moral of the story; good fab guys don't always make good businessmen.

To avoid that just do what I did, bought my own tools, learned how to weld (still learning actually) and do it yourself. If not then let me know if me and my SKS 7.62 can help haha.

Hearing about this stuff REALLY pisses me off...if these dirtbags worked as hard at the job as they do at being dirtbags, they wouldn't have to rip people off. I owned a restoration shop for 20 years, I NEVER had to advertise for work, because I was honest, did quality work, and delivered what I said I would...it's really way easier than being a thief! And, I don't even have to watch my back all the time! Glad you're getting the word out about this guy, just sad that you had to go through this, but it will catch up with him eventually, one way or another...

hey shotgun, as you are in cal, you got the bureau of automotivve repair on your side. unlike the bbb wich are powerless fags, the b.a.r. can hammer auto related business's that rip you off. ask anyone in the car biz, they will agree that the bar is the last people you want in your shop

maiin officce is in sacrememnto, and they have many local, and web sites as well


if he didnt get a signed work order out of ya, thats enough to get an investigation going, regardless of what happened next.

while i like some of the other suggestions, they arent as practical these days as they once were

1960 Galaxie. I have her in the shop now, all stripped down almost all the cancer has been taken care of, all sanded down. WOW in only one week. Going to paint her next. I want to bag her and of cousre the upholstery. Going to post pics later today

I agree with Highlander, do it legal.File a judement. File a written complaint at your local cop shop. I know you can"t get blood from a stone. When you get the address of the shop.Phone the Fire Marshall,health + safety, noise bylaw, business bylaw enforcement....REVENUE SERVICE !!! It"s good to hit them in there pocket book, not there face. Oh maybe a little later down the road.

I had something similar happen with the guy that was building my 40x40 shop building. He built about 75% and just quit showing up. First there were excuses then he wouldn't answer my calls. I found out that he'd done this to other people. After talking to a lawyer I found out there is a thing called "Theft by deception". I filed charges and he was arrested. He fessed up and the Judge set him up on a re-payment schedule or go to jail. I got my money back. Don't give up and let this A--hole win. Hang in there...

judgements are kinda fun, if someone has really jerked you around. I had a buy owed me money (failed to pay for services rendered) - took him to court, he didn't bother to show up...got my judgement....the court checks with every bank in town to see if the person has money...each time they do that - the bill grows. If there's no money to seize, (there wasn't) you get to lien an asset (or more) - He had a business and a house - I put a lien on both of them. Also liened a property he owned in OR. He finally called me up and offered to pay the original balance - told him the time for that was long past - court was now in charge. He had a buyer for his house, and could not sell it because of the lien. He had to pay the court the original debt, interest accrued, charges for service on each and every bank they tried. It would up being about four times what he originally owed. I got my money back, and the interest. Going the legal route provides substantially more satisfaction then any other type of retribution - I've tried both, and you're on safer ground with the law on your side instead of banging on your door.

Get on down to small claims court (make sure you don't exceed their limit in your state) and begin the paperwork. They will need to know his legal name and any and all addresses you have for him.

best of luck - next time repeat: "Caveat Emptor" five times before you dig out your wallet.

Yes, this is truely a "traditional" site. Long standing traditions, such as being ripped off, and being taken advantage of, have been going on since the first civilizations. With the "information highway" we have today, I am surprised this situation can and does still occur. I feel your pain, but simply put-trust is a powerful thing, not to be given or taken lightly. These low lifes seem to have an uncanny perception of identifying their nest subjects. They typically have a smooth tongue, and can sound quite convincing, a true salesman..don't be fooled (I'm sure you won't be again). Good luck with resolving this matter, however you get it done.

It sucks, but don't get too discouraged. I had the same thing happen to me back in 1999. Mike Bond in Rockford, IL on the corner of Rt 2 and Prairie Road screwed me big time. I put his name and location in case anyone Googles his name in the future. I drove my '52 F-1 Panel to his house, gave him 2000 bucks to buy and install a subframe and put it all back together "turn-key", he sent it back to me on two different tow trucks, stole my Buick engine and transmission, sent me a crap Chevy engine and transmission, and then told me I'd never get it back on the road. Long story-short, I learned a valuable lesson, and haven't had anyone else work on ANY of my vehicles for ANY reason since. I've done it all myself, and have probably saved that $2500 in labor twice over in the past 11 years. On top of it, I know every square inch of my '57 F100. The only bolts in the entire truck I haven't had out are the cab mount bolts, and that'll change this summer when I learn to paint it. I went from being a "I don't know how to do it, so I'll pay someone else to do it" kinda guy to a "I don't wanna pay someone else to do it, so I'll learn to do it myself" kinda guy. I still get pissed when I think about it, but in reality, that 2000 bucks turned out to be money well spent.

If you were up north I'd let you use my garage/welder/paint etc.

But for all the bandwagoners. I hear ya I've been screwed too and its the main reason I do my own stuff. I've been building rockcrawler for about 15 years.

At the point I got pretty good I started helping others and I've been screwed more by people I've helped then people I've hired. I've had to dispose of vehicles, parts, animals left at the property, and take random knobb's girlfriends home. Not to mention all the times I've never been paid for service and parts. Even times it was as simple as a six pack for fully welding in a cage.

I'm sure I'll get boned again but I guess its the price I pay for being a suedo nice guy and sleeping well at night mostly.

thats my $1.25 any ways.

Small claims is great, and spend 10 bucks on a nolo press book on how to collect the judgement. Or you never know, he may actually show up, stranger things have happened!

Feeling ripped off in about every experience I've had paying someone to do work, I noww do everything myself unless its a breakdown emergency.

It's amazing the stuff you can learn to do when you put your mind to it!

Wow, small world! He was staying right next door to me @ Viva earlier this month.. I had never met him before, he came up and introduced him self to me and he seemed like a nice guy, first impression of course.. really surprises me to hear this..

I trusted a friend of a family friend with a car of mine gave him 2000 to get parts and 1500 in labor to start the project long story short I lost it all and had my car dumped in the industrial side of oakland. I was going to beat this punk down but because of a baby on the way i didnt want to get into trouble...... So i go to his house and it was vacant go to his shop and it was vacant and as im leaving around the corner i see him getting his ass handed to him by some folks who also got ripped off .... now all the money he took was going towards go for medical bills..

A former member of this so called car club sent me an email. He told me they are known for ripping people off and posting ads on craigslist for their so called "shop work" This former member was also burned by the club. Why would anyone want to do business with them?

Mike was the most beautiful person I have ever known inside and out, an amazing father, husband and friend. He left us so suddenly a true tragedy. I will do all that I can to help his wife and kids get through this and help my girl in any way that I can, if I had the moneythat is owed to me I would give it to her and the kids, I love them like familly and it's just not fair. Mike I miss you and love you! Promise to take care of the family till the end.
