Just wanted to let everyone know that the grand jury indicted Terry Badgewell for the murder of our good friend Shawn Howard. Badgwell is being booked on murder1 and assault with a deadly weapon.

I'd like to once again thank everyone for their kind words and the outpouring of support when Shawn was attacked and during the campaign to have his killer brought to justice. There's no folk like HAMB folk.

Thats some good shit to hear. Maybe sometimes the justice system can sort of work if you work at it long enough.

So do they actually have bitchwell in custody or is he still in hiding? because the last I heard was that they had told him to leave town because they were worried about somebody avenging shawn.

Tulsa - Emotions are running high after a grand jury indicted a man in the death of a tavern owner. It comes after hours of endless petitioning for a grand jury. NewsChannel 8's Diane Harrigan spoke with the family of Shawn Howard, who collected more than ten thousand signatures to bring this case to a grand jury.

The Tulsa County District Attorney refused to file charges, saying it was a case of self defense. But, the family is calling this a win for the voice of the people.

Kay Howard hugged her son Mike after word came down that a man will head to court in connection with her other boy's death.

Shawn Howard died June 25th near his Deadtown Tavern in the Brady District. He had been beaten with a pipe during a fight with a homeless man, Terry Badgewell. Badgewell has now been indicted by a grand jury.

"I haven't had a chance to thank the grand jury for this decision," Kay Howard says. "I'm so grateful. Shawn can't be here to speak for himself and he deserves that day in court."

Some are still upset that it took a petition with 12-thousand signatures to bring it to a grand jury leading to the indictment, after the D-A refused to file charges, supporting a case of self-defense.

"I feel he definitely should have looked into this a lot harder," says the victim's girlfriend, Shayna Krieger, who still harbors hard feelings.

But, District Attorney Tim Harris will not be prosecuting this case. Instead it will be turned over to a special prosecutor appointed by the Attorney General. Reached by telephone, Harris said, "I respect the Grand Jury. I will cooperate and lend whatever assistance I can."

For the family, they know there's a long road ahead in the courtroom. But, they believe Shawn Howard would thank them.

"I'm sure he'd be proud of what we've done. He deserved this."

Terry Badgewell was also indicted in connection with the beating of bar manager Josh Martin. Martin had no comment tonight.

Meanwhile, Badgewell is in custody in Arkansas on a case unrelated to this one.

The unrelated charge the bastard's jailed in Arkansas for is stemmed from a 1997 conviction for grand theft auto, running a roadblock and resisting arrest.

He's been inside since the beginning of Nov.

Our wonderful DA was so quick to turn him loose that he didn't even bother to check and see if he was wanted elsewhere.

So, he turns a guy that committed murder, self defense or not, loose on the streets without even checking to see if other states a shot at him.

Very nice.

Another way to look at it may be that Badgewell turned himself in in Arkansas to muddle up these proceedings and or just get a roof and some meals down him.

Either way, he'll get his.

Shawn will at least get his day in court.

And the DA will get his. Big time.

He comes up for re-election in '06 and we need to begin finding a candidate to run against him this time. He was unopposed in the last election.

I too would like to thank all with their thoughts, prayers, donations and all other assistance we received through all this and woul like to thank those of the HAMB on behalf of Shawn's mother, Kay.

We raised $5,776. through the HAMB and the money was applied towards the funeral costs, specifically the purchase of Shawn's headstone.

And, of course, a HUGE THANK YOU to Ryan for all he did/does to make this all possible.

Other states? The fucker was wanted in other counties!!!! He had a warrant in, if I remember correctly, Cherokee County for some kind of domestic assault.

I heard he was staying with family in Arkansas and the Van Buren pd got wind that he was in town and served the warrant on him, but it may have been a ploy arranged by his lawyer. The warrant was failure to pay fines and court costs. Somehow I think if I stole a car, ran a roadblock and resisted arrest I'd get more than fines and court costs.

Bitter sweet to finaly get the wheels of justice moving, I'm happy that there maybe justice comming but it shouldn't have to be this way to begin with. bitchwell should have been in jail long before someone lost their life. Once again my deep felt condolences to all who knew and loved Shawn.

The kicker of it all over the petitions is the family would have had thousands of more signatures if it weren't for the fact you had to be a registered voter IN Tulsa County. I didn't even get to sign the petitions because I live in Creek County. West Tulsa is in Creek County, how fucked up is that?

I'm so glad that there is positive progress in Shawn's case. I hope this helps with closure for the family. It's just not the same scene without Shawn around.

This is kinda long, but here's what I know as far as updates on the murder of Shawn Howard, and the case against his killer, Terry Badgewell.

Well, Badgewell decided not to fight extradition and a couple of Tulsa County sheriffs drove to Ark. on Friday and brought him back. He's languishing in the Tulsa County Jail as we speak.

It's a da*n shame that we all had to go through this -- any of this. But we're here, and we'll have our day in court. Finally. ... Shawn, we love you.

Apparently, if my math is right, there were 19 officers that testified to the grand jury -- only 4 were actually called (the responding officers). I've heard that many of the officers were at shift change and swung by the scene, heard the call on their radios, or had worked as detectives on the case. They VOLUNTEERED to testify! That's impressive. Shawn always did have a close and friendly relationship with the police department -- and it paid off.

Also, I've heard (I saw a copy of Badgewell's indictment) that the lead medical examiner also testified. And the lead ME and coroner had both determined -- based on Shawn's wounds -- that his death was obviously a "homicide." Shawn had NO defense wounds. How can Tulsa DA Timmy Harris ignore that powerful evidence? Has he ever even learned how to read? I guess those questions are moot now, because we've been forced to rally for justice in spite of Harris' incompetence.

What else? Oh yeah, and the grand jury's 10-page report also roundly rebuked Harris (can you say "new arsehole"?), making additional recommendations to Harris that he (my words here):

1) keep better records, complete the records that he's required to complete, keep a better filing system for that information, make it readily available

2) keep his bleating yapper shut on why he will or won't prosecute a case BEFORE he goes to the press and makes a retard out of himself and essentially blames the victims and the victims' families for a crime that he's refusing to prosecute. (which is what happened to Shawn's family and Josh Martin, the bar manager who was also beaten)

And what happened then? The DA went scurrying back to the media to defend himself. Nice try at self-defense Harris, but you've essentially killed YOURSELF as far as your career goes. Harris and his delusions of adequacy. Forget about your aspirations at becoming mayor. NO MATTER HOW MUCH YOU "PRAY" ABOUT IT, IT WILL NEVER HAPPEN. GOD HATES YOU, MR. Oh yeah, and Badgewell's attorney has made the most telling comment yet about how he really feels about his client. Steve Hjelm was quoted as saying that people were just wanting to go after Badgewell because "he fought too hard and too long" after the initial confrontation occured. WELL, WOW, NO SHITE! That's why it's MURDER instead of self-defense, you shylock. Not only that, but if you choose to chase someone down from behind, knock him down with a blow from a heavy 24-inch pipe, beat him unconcious and stand over that person and continue to deliver an estimated 10 MORE BLOWS, it's freakin' FIRST DEGREE murder, smarty pants.

I know couple of other families going through a similar hell with the DA right now, too. Both had sons that violently lost their lives, and the DA is being a weenie about both cases, which in my humble opinion should both OBVIOUSLY go to trial.

Trust me, there will be MORE THAN ENOUGH to get this crap-wallower out of office in the next election.

It's not that he has too much paperwork. He heard "bar," "after hours," "hotrodders," "brass knuckles" and "homeless" -- and decided he could blow us off. He was wrong. Soooooooo wrong.

We needed 4,000 valid signatures (from registered voters living in Tulsa County) to get a grand jury called, and we got almost 11,000.

I'm sorry I missed this thread the first time around... I, like many others who have responded here, have been wondering how everything has been going there in Tulsa, so this morning I just searched on Shawn's name...

I'm very glad to hear that Harris's complete incompetence is out in the open, and that it seems Badgewell will be held accountable for his actions... viva la HAMB!!

It's interesting how a group of people with a common interest in rusty old heaps can make a huge difference... I'm glad so much was raised for Shawn's family through the HAMB and I'm proud that I was a part of that... I proudly wear my Deadtown shirt to cruises and shows around here (Scottsdale, AZ) and will tell the story to anyone who asks - and now I can tell 'em of a positive new chapter... I hope Shawn's family realizes how many people (internationally even!!) have them and this situation on their minds and it gives them some extra strength - just look at the location of people on this thread!

Best wishes to everyone in Tulsa involved in all this madness, and I hope the trial is quick and justice is swift!!

Interesting that this came up today - I was just about to post and let everyone know that the arraignment starts to day at 1:30 central.

There will be no pretrial to reveiw the case. The theory of why there will be no pretrial is that the Special DA assigned to prosecute this is not going to accept any plea bargains which usually happen in pretrial.

The arraignment will have arguments for/against bail.

With any luck bail will be denied and the trial date will be soon.

I should know more later today - I have somebody that's going to the arraignment and is going to call me.

Maybe we will see justice for this after all - it can never bring back our friend but it may lift some of the weight.

Not sure what the qualifications are but rest assured there are lots of people waiting in the wings to run against him next term - and to say that he will be campaigned against vigorously would be an understatement.

The Tulsa PD has never liked Harris - his standards of charging and prosecution make the city unsafe for the residents and makes the polices' job more difficult and dangerous. The FOP has spoken out against Harris in the past because of this.

Criminals aren't afraid to be arrested here - they know that Harris won't charge them and they'll be right back out on the street.

Other than that theres the fact that we believe he re-lables crimes to lower the city's murder rate and disqualify the victims of violent crimes from receiving city funds to pay for their medicl bills and related expenses.

Small correction - today was the preliminary hearing, not the arraignment. Apparently the defense attorney convinced the judge to hold a preliminary hearing after all.

Arraignment has been scheduled for Feb 22.

I have been told that Badgewell was sticking his tongue out at people and smiling during the hearing.

It came out in the hearing that he was in Parkside hospital for evaluation the night before the incident.

We knew there was a domestic abuse charge from a few years ago - apparently he tried to bite his mothers finger off.

The last I heard, the charge is going to be murder 1.

And the beauty of the Grand Jury is that these people don't have to worry about the outcome effecting their political careers.

He's gonna swing.

Oklahoma prefers the "Lethal injection" method but electrocution is still on the books along with the firing squad.

I doubt he'd get the death penalty either way.

Sadly, life in prison will be better for this fucker then what he had.

I just hope they smear peanut butter on him, turn him loose in Gen Pop and take away anything that may serve as lubricant.

As hard as his family and friends had to fight to get this far,
it appears there is a greater likelyhood of seeing justice done,now,
than if Tim Harris had pressed charges originally.

A half hearted prosecution would have been worse than none at all.
