Last week I got cliped on the way home from work,
and the guy Doesn't appear to have any Insurance.
I Only have a Priliminary Report.
But my 1965 IH Scout is non-operational ( The whole front clip is trashed and the front axle and springs are done)
What is gonna be the best route of action from here?
Any help will be greatly appreciated.

I'm not sure how Cali is, but MI is a No-Fault State, which means that if someone hits you and they don't have insurance you're screwed! http://www.jalopyjournal.com/ubbthreads/images/graemlins/confused.gif
I got rearended buy a guy with no Insurance, and after tracking down his phone number, I got him to agree to pay the $500 maximum he's liable for in MI, WITHOUT going to small claims court. I am not sure of the laws here NOW..I got nailed by an uninsured motorist and got screwed. So now I carry uninsured motorist insurance.

I don't know about the States, but Canada you get automatically a $5000.00 fine for driving w/o insurance.
Possible jail time too.

sorry to hear about your wrech- make sure you get all the CHP report or police report- get a lawyer- screw them!! make sure you reoccuring neck pain returns when your talking to your lawyer!
Usually uninsured motorist don't have any cash to payout crashes; so one way or another your screwed, I'd get a lawyer- like the on on the 222-2222 Ads on the bus!

If you know where this guy lives, go to his house and destroy anything of his you can get your hands on. When he comes out to say something beat his ass and put him in the hospital.
I'm so sick of this post it enrages me to no end. I was run over by a piece of shit in Houston who totaled my bike and used fake insurance at the hearing. I saw him later and should have done the above. It would have made me feel alot better.
Bottom line is that insurance companies and the police could give two shits about you and your property and evidently, the same goes for this jagoff.

This is a shitty deal, it seems that the low life that hit you gets away for free while you have to suffer. Although I'd like to say kick the fuck out of him, if you do you will be the one in trouble cause he will most likely sue the shit out of you for doing what's right. So don't take it out on him, unless your pretty sure you can get away with it of course.

The problem is that most people without insurance are also without money, period.
You know the old saying about getting blood out of a stone? Well the same principle applies to filing lawsuits against people with no money. I know a little bit about this, as I have been involved in countless lawsuits against debtors who refused to make good on their loans.
You might waste good money suing this idiot just to find out he's got government liens on his wages and property for unpaid child support. taxes, former judgements, etc., at which point you are at the end of the line (which basically means you're fucked).
Here's a little free advice for everyone -
Don't ever file a lawsuit against someone without spending a few hundred dollars with an investigative agency to do an "asset search". Bottom line, if they have no assets - there's no sense throwing good money after bad trying to sue them.

Oh, and one more thing -
Most of the laws concerning uninsured motorists aren't worth the paper they're written on.
Why? Two words - "officer discretion".
My ex-girlfriend (who was pretty decent looking) caused an accident driving while blabbing on her cell phone, had no insurance, an expired license, an expired tag, and basically all of her legal obligations in disarray. What happened? The cop gave her a ride home and his phone number "in case she needed any help sorting all of this out".
Basically the cop thought he could get a date out of it so he pretty much screwed the accident victim by not citing my ex. Funny how that works huh?
I had a similar incident where a lady hit me in my old tow-truck, had no insurance, cried her eyes out, and the cop pretty much told me "I'm not arresting this poor old woman just because you want me to". Uhh, no officer, you should arrest her because SHE BROKE THE LAW AND NOW I'M ON THE HOOK YOU FUCKING MORON!!!!

Most states you just go to the DMV and sign something, maybe give them a couple bucks, and they will run a plate for you. You can't do it annonomously though.

check your own policy - you should have an uninsured motorist clause that should cover you.

I have the assholes address on the report, but doing time for beating this jerk off stupid won't help me get the old girl on the road or,
be good for my 3 young kids to be without their dad for 18 month to 3 years.
