This reminds me of the story of the man who invented straight pipes. Sometimes referred to as scavenger pipes, and more correctly known as scag pipes, they were actually named after their creator. After offering to supply them to Ford Motor Company as an option for their high-performance Mustangs, the attorneys realized that his first name was a trademark infringement, and forced him to change it.
And that, Sherman, is the story of Boz Scaggs.
In a related story, Ford has ordered Bruce Springsteen to change his nickname, and is so fed up he has announced his intention to become a dentist known as The Floss.
Now go to sleep.

Volkswagen is the worst! They made everyone in the aircooled VW mags stop using their emblem, said it was infringment! I bought a new ignition, NOS, from a VW shop here in town and guess what?.....They had to file part of the V and the W out of the center of the key! The key looked all #ucked up then. I hate VWoA, and not just for those reason's. http://www.jalopyjournal.com/ubbthreads/images/graemlins/mad.gif
yeah, thats another reason i got out of the vw's. a local dealer of parts lost a lot of stuff, vw came in a just took it. it also happened to a big dealer in colorado springs. i guess its nothing new, porsche does it, and the big italian guys have done it too.
i need to start copyrighting things.

I knew a guy that had the same problem with Speedway a long time ago. He ahd an Irishman working for him at the time, they put a shamrock in the logo and the problem went away.
Its funny how trademark infringment works, sometimes a little change makes all the difference in the world, and sometimes it don't.

I'm waiting for the lawyer smart enough to sue FORD for leaving their logo on his car after they sold it to him. Surely we should all be paid a fair price for advertizing these corporations. Tiger Woods gets big bucks for wearing that Nike logo, why shouldn't I get a few bucks for showing the car logo. Budweiser should pay me too as i'm always displaying their logo in my hand. In the garbage! We'd spend hours putting these goddamned tags on the shirts, just so people could cut them off and throw 'em out....retarded shit...corpoate greed sucks donkey dick....

Interesting, has anyone ever thought that maybe things are too "free"? Let me elaborate, in this country we can sue those that we victomize if they retaliate i.e. I break in your house or car you shoot me and I sue you for loss of income while in the hospital then tack on another 1.5 mill for pain and suffering. In this country we copyright even the words that we speak, if I want to own a word all I have to do is spread enough money around to get it copywriten and presto I own the word and you can't use it and if you do you have to pay me big time. The trademarks and copyrights and patends were great when they protected small kats from being associated with and obused by industry, now guess what there only purpose is to provide lawyers with jobs with'n big industry. I work for a large corp. and they have lawyers that all they do day in and day out is look for ways to get around patends and to make sure no one has there hands in our kool'aid all in the preservation on the all mighty buck. Don't get me wrong I understand not wanting hands in your kool'aid but fuck they don't pass the savings on to consumers or employees. The guy that I replaced did half as much work as I do and I'm being paid $2 an hour less than the bottom of the grade. Anyway I say we copywrite the words "copywrite, patend, and trademark" then everytime one of these mofo wants to use it in a contract they'll have to pay up to us too. My stand is this the words we speak shouldn't belong to anyone but the person speaking them. Hmm maybe I'm wrong maybe our freedoms are actually more restricted than we think........... http://www.jalopyjournal.com/ubbthreads/images/graemlins/smirk.gif

You know I was going to say that Harley Davidson is way on the other side of this. They let everyone throw their name around for as long as they wish. That has to be part of the reason for their success. You can be a Harley guy and be proud of it. Get an HD tatoo, does HD make money? No. The tatoo guy does. Does HD go after him? No. Paint a big bar and shield on your garage wall, they don't care. I mean how many "home-made" HD logos do you think you've seen in your life. Probably more than real ones.....The point is it puts their names in everyones mouths. They HAVE to love THAT. Most HD guys wouldn't give a fuck if HD folded tommorrow. They'd just keep riding and building HD's anyway. It is in their hearts and in their blood.
With that being said. They aren't going to let you build a Harley based motor (like S&S did/does) and slap a HD badge on it. I mean that is staight up robbery of the HD name. If you are making your own product but selling it as a big name product what do you expect? I can see why VW could get upset. Unless you have bought rights to the name you should get penalized, even if it's just a hubcap...
I have heard stories of people building home-made HD gas pumps and petal cars etc. etc. and trying to sell them at swaps or on ebay. That's not exactly right either, because (I assume) they are jacking the price way up just because they know HD stuff is hot and easy to sell. They are makeing money off of the name. I have been told that Harley DOES go after these kind of guys. So, I guess, be warned...
I work in a sign shop and people come in all of the time and want us to make decals so they can build stuff like that. Generally, if it is a one time only deal - and a personal project just for the customer, we do it. However there are certain people who we know are going to try to re-sell the product we refuse to do it. The lines get pretty blurry. We always ask what they are doing and if it seems shady we send them on their way. All it takes is a good liar to get by us unfortunatly but you'd be surprized how many times people will spill their guts...

I thought it was "Hairs Around My Ba.."
Chrysler went after JEEP's Bar in Alpine Wy. a few years ago. JEEP finally won but it cost him years of frustration and a shitload of money to defend himself. On the other side, all those great car models we built as kids went away when Chevrolet & Ford went after MPC, Revell and the others.
I can see copyrite being a good thing for a band with a record or a car company that doesn't want cheap overseas parts miss represented as their product. That only makes sense. But when the singer dies, the copyrite should go with him. Car companies shouldn't squeeze model makers for use of their logo.
Corporations buying up copyrites and trademarks to milk royalties forever in areas of business the company or artist was never involved in should never have been allowed in my opinion. The way it is today, if Johnny Ace paints a Rat Fink in a Model A, Ford lawyers could sue him for infringement and if he makes that Model A look funny in a way Ford doesn't approve of, they'd nail his ass for defamation and damages too. Even tho Ford hasn't made a Model A or even a part for one in 70 years and they've never been in the painting business.
Do royalties for Beatles records go to the surviving beatles? Or to the record lables that made the records?
Nope, they go to Michael Jackson and the RIAA because they bought the rights. I don't think the rights should have ever been allowed to be for sale.
And the idea that a company can own a word like BOSS is a sad comentary on how far the liberals and lawyers have manipulated this country of sheep.

Lets not forget that Pontiac used the GTO badge name after they stole it from Ferrari and their Gran Torismo Omolagato because they did not have it copyrighted. Let alone the GTO went on to make a great name for Pontiac and was one of the original muscle cars.
There is also currently a rodeo company in Texas that stole the bucking bronc logo that the state and University of Wyoming have used since the cavemen. They said it was an abandoned logo, but are currently in litigation.
Too many lawyers, greedy businesses, and people wanting to steal recognizable icons to gain a business edge (damn rodeo company).

Yeah VW really got a bug up their ass(pun intended)when the National Lampoon magazine ran a phony VW ad.If you remember when VW was running their ads touting the fact that their cars were so watertight they'd actually float?
Well this was about 1970 and the Chappaquiddick Incident(where our friend Teddy the K offed a certain person)was still fresh in a lot of minds and the Lampoon runs a pic of a half-submerged VW with the caption:"Poor Teddy! If he'd been driving one of these he'd be President today!"
The suits went apeshit and sued them for millions and made em take all the magazines off the stands.I think that was the birth of political correctness in this country.

Thanks for the comments guys, both the good and the bad.
Funny thing, I have a scan of a 1963 issue of R&C, and it has Ed Roth on the back cover, and he has the word Boss as an adjective in the bold copy...it was a very popular word, found all through the pop culture at the time, well before they bought it in 1968....
It's not so much damn the man, as it is fighting for what should be mine. I have invested a bit into the Boss Ride adventure, including a vast portion of last year's tax return for the trademark application. To do it right and protect myself first...ha.
The wife & kids, and I sure could have used that money for something else if I knew I was going to have to jump through all these legal hoops...I did the trademark search, and scan, and according to them, it did not conflict with anything...but you have to post it for opposition, and that's when Fords sub-contracted law firm picked it up, delaying me with all the available time-staller motions they can file...this won't play out until late 2005, after which, if by some crazy chance I was to win, I'm sure they would file an appeal, blah blah, blah.
Funny thing is, they have provisions to prohibit companies from having a monopoly on a word, which is basically what Ford has, under a section called "fair useage". This has provisions for me to justify my using Boss as a non-market confusion causing adjective to describe everything from 70's snowmoblies with hemi's to gassers...it was a common adjective. Ford used it for a perfomance package for a car, and unless you are directly tied to their cash, like Boss Performance, you can't have the word boss for squat.
It would be like Honda making an "Awesome Accord", and trademarking it, and then having dogs chase down everyone using awesome. Fair useage...
But I am me, and they are Fords sub-contracted law firm with years of experience and a billing department that won't quit, so we will see that if here in noble America, truth and logic prevail, or cash.
Wish me luck, and I will build another site soon with 3 times the showrod pictures, I had just been gearing up to update the site...

Absolutely right about the Hondas ElPolocko. For years we have taken the wife's Civic to a Honda repair shop. The guy had to change the name of his shop to not include the word Honda only thing is, they could not make him change HIS name which is Rick Acord (one "C").
A number of years ago Scale Auto Enthusiast magazine ran a contest to build the new Batmobile model. The model company who produced the kit pulled the plug on the name, "Build the Batmobile Contest". So, along with a pic of the new Batmobile, the new name was "Build the Kit No. ######## Contest" There is always a way around it I suppose.
Unfortunately, Karl's Custom VW here in Phoenix had to drop the VW in his shop's name recently. Pretty much the only game in town for strictly VW air cooled stuff so the locals know what they sell anyway.
